EB-1A: Aliens of Extraordinary Ability

EB-1B is designed for internationally recognized academics with qualifying U.S. institutional employment.

  • International recognition in a specific academic discipline.
  • At least three years of research or teaching experience.
  • A qualifying permanent research or tenure-track teaching offer.

EB-1C: Multinational Managers and Executives

EB-1C supports managers and executives transferred from overseas related entities to U.S. operations, often as part of long-term multinational expansion.

  • One year of qualifying employment abroad in the prior three years is typically required.
  • U.S. and foreign entities must meet qualifying corporate relationship requirements.
  • The role must be managerial/executive in nature with credible organizational evidence.

EB-2 / EB-3 and PERM Labor Certification

EB-2 serves advanced degree professionals or individuals with exceptional ability; EB-3 serves professionals, skilled workers, and other workers. Most employer-sponsored cases require PERM first.

PERM highlights

  • There must be a bona fide full-time permanent job opportunity.
  • Requirements must reflect normal occupational standards, not tailored to one beneficiary.
  • Prevailing wage and proper recruitment/document retention are essential.

EB-5 Investment Immigration

EB-5 provides a pathway through qualifying investment and job creation. Investors generally move from I-526 filing to conditional residence, then I-829 to remove conditions.

  • Requires a record of distinction and field recognition tied to the proposed U.S. work.
  • Can be extended beyond the initial validity period when project needs continue.
  • Useful in high-skill transition planning when timing under other categories is constrained.

J-1 Exchange Visitor Program

J-1 covers a broad range of exchange categories including students, scholars, teachers, trainees, and physicians. Duration and terms depend on the specific sponsor program and DS-2019.

  • Must be sponsored by a designated exchange program entity.
  • Some participants are subject to the two-year home residency requirement.
  • Future status change planning should be evaluated early to avoid timing conflicts.
