EB-1A: Aliens of Extraordinary Ability
EB-1A is for individuals at the top of their field in science, arts, education, business, or athletics.
It does not require a permanent job offer or labor certification.
Common evidence framework
- Major one-time award, or multiple regulatory criteria showing sustained acclaim.
- Published materials, judging work of others, original contributions, and scholarly authorship.
- Leading/critical role evidence, high compensation, or comparable evidence when criteria are not a direct fit.
Success depends on a consistent record proving national/international recognition and future U.S. work in the field.
EB-1B: Outstanding Professors and Researchers
EB-1B is designed for internationally recognized academics with qualifying U.S. institutional employment.
Typical legal requirements
- International recognition in a specific academic discipline.
- At least three years of research or teaching experience.
- A qualifying permanent research or tenure-track teaching offer.
EB-1C: Multinational Managers and Executives
EB-1C supports managers and executives transferred from overseas related entities to U.S. operations,
often as part of long-term multinational expansion.
- One year of qualifying employment abroad in the prior three years is typically required.
- U.S. and foreign entities must meet qualifying corporate relationship requirements.
- The role must be managerial/executive in nature with credible organizational evidence.
EB-2 / EB-3 and PERM Labor Certification
EB-2 serves advanced degree professionals or individuals with exceptional ability; EB-3 serves
professionals, skilled workers, and other workers. Most employer-sponsored cases require PERM first.
PERM highlights
- There must be a bona fide full-time permanent job opportunity.
- Requirements must reflect normal occupational standards, not tailored to one beneficiary.
- Prevailing wage and proper recruitment/document retention are essential.
EB-5 Investment Immigration
EB-5 provides a pathway through qualifying investment and job creation. Investors generally move from
I-526 filing to conditional residence, then I-829 to remove conditions.
- Can be structured through direct investment or a regional center model.
- Source of funds and funds path documentation are heavily scrutinized.
- Job creation evidence planning should be designed early in the case.
Family-Based Immigration
Family immigration includes immediate relative categories and preference categories with annual numerical limits.
- Immediate relatives generally include spouse, minor child, and parent of a U.S. citizen.
- Preference categories include certain adult children, siblings, and LPR qualifying relatives.
H-1B Specialty Occupation
H-1B is a nonimmigrant category for specialty occupations requiring theoretical and practical application
of specialized knowledge, usually with a related bachelor's degree or equivalent.
- The employer files as petitioner and must prove a valid specialty position and wage compliance.
- Common fields include engineering, software, finance, healthcare, and legal/scientific roles.
- Cap timing and annual quota rules make early strategy planning important.
L-1A / L-1B Intracompany Transfers
L-1A supports executive/manager transfers; L-1B supports specialized knowledge personnel. It is commonly
used by multinational companies building or scaling U.S. operations.
- Requires qualifying relationship between foreign and U.S. entities.
- Evidence focuses on duties, org structure, and real operational capacity.
- Often paired with future EB-1C planning for permanent residence.
O-1 Extraordinary Ability Nonimmigrant Status
O-1 is for individuals with extraordinary ability in sciences, education, business, athletics, or the arts,
including motion picture and television industries.
- Requires a record of distinction and field recognition tied to the proposed U.S. work.
- Can be extended beyond the initial validity period when project needs continue.
- Useful in high-skill transition planning when timing under other categories is constrained.
J-1 Exchange Visitor Program
J-1 covers a broad range of exchange categories including students, scholars, teachers, trainees, and
physicians. Duration and terms depend on the specific sponsor program and DS-2019.
- Must be sponsored by a designated exchange program entity.
- Some participants are subject to the two-year home residency requirement.
- Future status change planning should be evaluated early to avoid timing conflicts.
